Express Tools "Sync Viewport" doesn't work

all my express tools work except for "syc viewport" from the Layout Tools flyout.

i don't get it, i just went into the same drawing where it wouldn't work and now it works.
i wonder if there is something that affects the startup or running of this routine after you have been in a drawing for some time

when it fails again i will screen shot the command line to help diagnose the problem
