Building Pad keeps drawing as Topo

im trying to draw a path with a building pad (so i can have a surface pattern) everytime i draw it, it becomes a Toposurface and not a pad.

it is driving me mad!

i think i know why, as my site plan isnt a proper level - it is one i made.

how do i link it back to so when i click on site plan it opens the site tools.
