Are you on subscription?
If so then yes. If not then you'd need to buy the upgrade.

Good Deal! We are on the yearly fee on each seat to get the latest edition, so I think what I am hearing from you is that the 2010 is not a "Upgrade", but rather a full copy of the software.
We chose not to load 2009 last year, but feel compelled to go ahead and get back on track with the releases.
Thanks for your help!

You'll want to double check with your reseller to be sure.
But yes, for each license under subscription you can install 2010 and it is not priced separtely.I believe You will have to either remove the 2008 or have a network license server setup. Skipping 2009 had no effect on that. You were entitled to it under your subscription deal, however, not using it makes no difference.

Just an FYI, there is really no such thing as an "upgrade" version. The software is all the same. The terms "upgrade", new license", etc. only apply to licensing and not the actual software and/or media.

Nuhuh, you've gotta load 2009 and spend at least six months working with that and then you can load 2010. It's a new rule, they made it yesterday, they just can't have folks skipping around to whatever issue they want. AND if they catch you loading and using issues out of turn, the penalty is that you have to go back to AutoCAD 2004 (without any toolbars) and start all over again!!!
Sorry fella, but it looks like you missed the ship...
